I was in the US on a J-1. Returned to home country after two years. Received a waiver after returning to my home country. I am back in the US on a J-2. My husband has not got a waiver still. Can I apply for a H-1 based on MY J-1 waiver? Is my J-1 waiver still valid.

Please help.

You need an employer to apply for your H-1 visa, once you have accepted a position. Contact an attorney who specializes in immigration for the best information.

Hi

When you accepted the J2, based on your husband's J1, you are bound to the 2y rule again. Therefore I don't think you can apply for a H1 now. I'd definitely seek legal advice to see if there's anything you can do.

no, you can't
if you are on J-2 you have to wait until your husband gets a waiver, then you can get H1-B
