UW says childbearing DOES give a minor emancipated status in two different questions... Dr. Daugherty from Kaplan clearly says, IT DOES NOT! Any comments?

i don't mean to add a 3rd angle to this discussion, since you guys are focusing on kaplan vs. UW. But in Medical Ethics by Conrad Fischer, it describes emancipated minor as: A small number of minors, particularly at older ages such as 16 or 17, may be considered 'emancipated' or freed of the need to have parental consent for any medical care. The criteria are that the minor is married, self-supporting and living independently, in the military, or the parent of a child that they themselves support. The criteria for being an emancipated minor relate to being no longer dependent on one's parents for support. In other words, if the minor does not live with his parents, has a job, and is self-supporting financially, then the minor no longer is dependent upon parental consent for his actions. An emancipated minor is free to make health care decisions in all areas, not only just STDs, prenatal care, contraception, or substance abuse. Serious medical conditions or procedures such as organ donation, surgery, or abortion may require a specific court order to allow the legal standing of emancipation to be fully valid. Only answer "court order", "judicial intervention", "court trial", or "seek legal resolution" if the case represents disagreement or a lack of consensus in the stem. (DISCLAIMER: I'm not promoting Fischer, just happen to think he explained med. ethics in a really good way and is helpful in clearing up a lot of the grey areas.) gl

Hi Silver, Thanks for your reply.. This part is clear that partial emancipation is given to thos eminors living independently and even supporting a child . But in UW there is a question: A 16 year old female is brought in by her mother for complaints of nausea and vomiting. The patient does not show any overt signs of distress but remians quiet with downcast eyes while her mother talks to the physician .She denies any other symptoms, The physician tells the mother that he would like to interview the patient alone .. After her mother leaves the office the girl starts sobbing and informs the physician that a home pregnancy test she did yesterday turned out to positive . She pleads him not to tell her mother . What should be the most appropriate response of the physician ?? A) Ak her to inform her mother B) Do notinform her mother C) Inform the mother since she brought her daughter to his office D) Encourage her t inform her mother in his presence E) Remind her that it is his duty to inform her guardian ( her parent) since she is a minor What do u suggest ???

B. Reason being that prenatal care is the exception to the general rule of parental notification and consent for treatment of minors. So you don't have to inform the parents of this girl or even the father of the baby. And this confidentiality also extends to protecting her even if her parents outright ask you. She has the right to privacy for her prenatal care. (Remember exceptions are: areas of prenatal care, contraception, STDs, and substance abuse-- you go ahead and treat the patient--no need to ask for parental consent or notify them.) what does UW say?
