Hi!

I attend two –year program at a school. Last year, I got J1 visa with “two years residence requirements on my visa”. I went back last summer and apply for new visa to the same program (same sponsor), but I got J1 Visa with “two year rule does not apply” on my visa now.

My employer wants to help me get H1B visa, but do I have to serve the two year requirement or I am not subject to it?

Thank you very much

Lee.

you are still subject to 2 year HHR

Unfortunately you are stuck with the 2 year HHR. There is little you can do about it. Wish I could help more.

Lee - is this a waiver position following your residency?
