A mother brings her 3 yr old son for general check up.on reviewing the medical records it states that the child is not vaccinated,when asked she says that vaccination causes more harm than good.the physician explains the risk factors of not vaccinating at alength.what is the next best thing to do

a ) obtain a court order for vaccination

b) go ahead and vaccinate

c) write down in the medical record " explained all the risk factors of not vacciting the child"

d) obtain permission from father

whats u r answer?

(c) you can't vaccinate the child against the parents will (autonomy). This is not an emergency situation where you have to act in the child's best interest (e. g. multiple trauma, kid will die if not taken to the OR immediately)

As farnsworth mentioned if it is an emergency or something life threatening you treat.

The rule is this: Parents cannot withhold life or limb saving treatment from a child.
They DO however have the right to refuse vaccinations and other treatment like minor stitches, etc.

if the child dont have the vacc maybe he wont be able to go to school-there was some lawsuit by the state-maybe NJ?(i forget which) to force parents to vaccinate (i dont know the outcome)

but

as a doctor

you cant force shit to vaccinate. the child aint gonna die without it.

an unvaccinated child might not be admitted to day care/school etc.
but legally there is no way to force the parents to get the kid vaccinated. if you want to poke someone with a needle, you need informed consent (when you explain to a patient, that you have to draw some blood for tests and he/she does not object, this is taken as a consent).

I don't mean to change the subject, but I think we all agree with C, and this brings to mind a few more questions:


1. Consent to do something must be written? or can it be oral also?

2. You have a patient whose boss calls and asks about your patient. The thing he is asking is about your patient's health because it affects his work. What do you do? Tell the boss, say you can't discuss this information, or get oral permission or get written permission.

3. Same question as #2, but this time the patient is a bus driver and has narcolepsy. The boss calls you and asks whats wrong with this guy. Do you tell him now that there are other's lives in danger? or do you need permission from the patient FIRST?

1. yes yes

2. someone else wants medical information on the patient --> patient needs to give the doctor a WRITTEN release of records.

3. in case the patient's dz could lead to immediate deaths and all that, you need to report. you dont need the pt's permission.

the answer was c as u all have said but i still cant swallow the fact that parents can refuse vaccination and nothing can be done rolling eyes
