A 16-year old boy was diagnosed with osteosarcoma of the right thigh. The surgeon recommended amputation. The boy refuses amputation. He is doing very well otherwise. He is aware that death is certain without surgery. (Important) Next step in management: amputation should NOT be preformed. Adolescent patients or adults who are competent in making decisions have an absolute right to determine what shall be done with their own bodies. However, most pediatric patients are not competent to make their own decisions. Please remember, children (15 years or older) are usually able to give a genuinely informed consent. Therefore physicians may respond to their request, except in a case of irreversible sterilization. I found this question in one forum. Is it correct? can a child (minor)has a right to refuse the treatment? please correct me if I am wrong.

NO, he has no say about his medical treatment till he is 18 (not 15 -thats wrong).... The legal age in the US is 18. The only exception to this is if he is an "emancipated minor" -know the criteria.

emancipated minors are "independant", they have a job, pay their bills and do not live with their parents. important: have a child or marriage do not make them emancipated, is the fact that they are economically independant and do not live with the parents, must of them don't even have contact with the parents. also be in the army makes them emancipated

The criteria for being an emancipated minor are: -age of 13 or older and taking care of self eg. living alone without parents or guardian. -Marriage -Serving in the military. (you need to be 18 to serve in the military, but if he/she somehow got accepted into the military, at a younger age, then he is considered emancipated) Remember what does NOT quality for emancipation: -Simply having a child or being pregnant -doesn't necessarily mean the child is emancipated because he/she could be living with parents. Children DO NOT need parental consent for: -Substance drug treatment -Prenatal care -STDs -Birth control (For everything else you need parental consent) -the exception is an emergency, in which case you treat first ask questions later.
