has anyone ever applied H4 for spouse while on residency? i just wanted to ask whether our [low] salaries can be a basis for rejecting H4 for spouse (meaning, can we support our dependent on say $44K/year legally?) also, is it possible to apply for H1, get visa stamped, go to US for one year, go home and get married, then apply H4 for spouse? thanks everyone.

I have not heard of any one being rejected for h1 based on salary level. Median annual income is 40K per family in US. so you are OK with 44K salary.. While h1 if you get married, you can apply for h4.. it has to be routed through the employer... it takes some time up to 4 weeks..

thanks man. cause i was earlier thinking whether to get married before i get the visa. but if my spouse can get the visa just as well when the wedding is after i get the visa, then i'd choose the latter route.
