Hi,
I am currently on H-4 and will be starting my residency on J-1. I was hoping to change my status from US, but the processing time at the vermont service center is like 8mnths. Now should I go to canada or india(home country) for stamping? Is there a chance that I might be denied visa because of my husband's H-1 status. My program does not sponsor H-1 visas because it falls under H-1 cap.What should I say at the embassy in India and if I am denied the visa will I be able to come back on my H-4 status. Please anyone give some inputs, I am really confused. Thanks.

Can your hubby apply for a green card based on his job? That way you'd get one too!

you will remain on h4 status till approval of j1 visa and entry in US based on that visa.. now what i did not understand is how your program falls under h1 cap? if the residency you are joining is ACGME accredited, your hospital is an institution of higher education and is eligible for h1 out of cap..

I don't know really, but they never sponsor any H-1, what I could understand is that it is a for profit hospital and they say that if we sponsor you then you will not be able to start the program until october and they don't want that.

Also plastic_surgery do you have any idea if anyone recently got H-4 to J-1 from india? Any problem at the embassy? OR should I try to get it done from canada, but I guess situation won't be very different from india? What is better?
