Hi guys I accpeted prematch from a community hospital last week.But these days I am in a fix .The program is suggesting me to stay here until my stay on I-94 and than apply for extension until june.It all bcoz of highly unstable condition of my country.Program thinks if I go back home it is possible I might be stuck there or will not get my clearance in time.PC said, program will not wait if I dont make in time for residency. But on the other hand I cant stay that long its 6 months from now ,how I can afford it,means living,lodging ,This match has already drawn all the money out of my dry veins.also being a citizen of third world country doesnt help either.Filing an extension if I choose is expensive too.Like wise away from family for 9 months before residency if I choose to stay and when I start residency I will get only 4 weeks of vacation so if decide to stay here until june , I will going back home probably next year. I am not sure do I have to be physically present here as the program files H1 petition.I think I can do all the paper work from my home country so why should I stay here until june.....I dont know On the other hand I am pretty much sure I will not get stuck back home since getting h1 is not a big problem as I heard compare to j1.Is it possible that after getting H1 petition approved from states can I be denied of visa at my home country US embassy??or delayed?? So confused dont know what to do so asking for ....your help and suggestions what should I do

Considering you are from a South Asia or Eastern European country the most likelihood of you being denied a visa is more than anything else. If the program feels that you might not get a visa again in time then you will have to trust them cos they must have experienced it more than. And they dont have any other reason to latch on to you and make you stay here unneccessarily. Now the your point is that can you be denied visas after filing your pretition Yes. The reason supplied will wait for that petition to come thru and u will be granted the visa. I was naturalization candidate (like my parents are US citizens) and i applied for a visit visa got denied on the basis that i already have a immigration case going on and i m a risk to stay there illegally when all logic says otherwise. Most visa issues are dealt by the Consular Offices and they have most uncanny way of sorting of visas. The best thing for you right now would be to contact the local INS office and ask them. They tell you everything and also for free but there is a long line for it. Moi 2cents

For new_n_lost - I didn't know Eastern european countries have unstable situation and , believe me, I know what I am talking about. So- don't speak if you don't know! And you can not compare B visa ( visitor's visa) with H1 which is a work visa;if they gave you H1 means in few years LEGALLY you can be permanent resident. For match4 - I think it is better to talk with somebody from your consulate about the situation from your country. You don't have to be here when the hospital fills up the papers for H1. Even if H1 visa is approved here it is possible not to obtain visa from USA embassy but it is very unlikely.

To NE I apologise if somehow i have offended your National Pride for it wasnt my intention. And what i meant by Eastern European or South Asian countries was that its not the political unrest that dictates the visa granting issue. But somehow i got the wrong msg out. I m not the person to comment on the Political situation of the any country (even of mine) but what i was trying to impart was the uncertainity in timing and durations of granting visas. None of us are the experts here (in immigration atleast ). When i cited the Eastern European countries this thread came to my mind. http://www.prep4usmle.com/forum/thread/52140/ and i based my response to this experince though the member did get the visa eventually but he did face problems and also got it late , which was the basic reasoning of the program for asking the candidate. Therefore i simply advised the person to contact the INS or Immigration authorites as they are the final authorities in this matter. As to what is H1 and other different types of visas i do know them and i was simply stating my experience and pointing out the uncertainity of the Consular Officers. I m now a naturalized immigrant and have seen the tiresome procedures that goes along with it. Every country has is dealt differently but the general policies are more or less the same everywhere. The issue in the minds of the program are the delays that might occur due to any reason. The issues do tend to get sorted later than sooner but the program has informed the candidate that they wont wait. So therefore i asked him to call up the INS authorities cos they will be the ones ISSUING visa in co-ordination with US Consular offices in the respective country. So if my comments made you jump the gun i do apologise for it. Didnt mean in any way that Eastern European countries are unstable. I gave my 2 cents as always and those arent in any way letters of the law in any sense.

It's ok new_N_lost, I read the thread but I guess this is kind of unique situation; any East European country but the former Sovietic Union countries are now part of EU and , actually , I think we gonna see less and less IMG from there because is easier for them to go in EU. What you said about B visa it is true- they don't give you this type of visa if they think you are an potential immigrant. But with H1 is different - that visa means a company/hospital NEEDS you.
