Hi. I have a problem. My current I-94 is about to expire. I already filed an extension a month ago, but now the processing takes 3 months. Now I'm thinking of just going home and wait for the match there. My entry visa has already expired so I can't go back using that visa. I have heard that extension, even if it's legal, and even if it is approved, can create a lot of problems when applying for J1 or H1B visa. How true is this? I am done with all my interviews and will go through the match. How hard will it be to join the scramble, in case I don't get matched, if I am outside the US?

Did you receive notification that they received your application for extension?Did you send it certified mail- do you keep the receipt as a proof of you sending the papers? IFyes, then you can stay and it is absolutely legal - your case is just pending. I don't know about any difficulties later in terms of getting J or H1 ... I would think that even in your home country scramble should be doable, but it would be absolutely easier if you were here....

thanks. Yes, I have the receipt. I'm just worried because I read from posts of people getting denied J1 because of the extension. Many of the programs I interviewed in sponsor only J1. And if my extension is denied, I will be out of status which will not look good when I reapply for a visa

Idon't think that if you got denied you will be automatically out of status, they should give you time (i.e. like 10 days) to get out of the country...But I am not an immigration lawyer...

Plus I think you have greater chances of getting approved than denied, especially if this is your first application for an extension.

as far as J1...I really don't have any idea how this extension will affect you..If you really want to know, call up an immigration lawyer and pay him 50 bucks for a brief consultation, just an idea...

Yes medicus,
If extension for B1/B2 gets cancelled,he will out of multiple entry status irrespective of how many years(5uears or 10 years).

In the past, extension of B1/B2 has affected the J1 application status. I know of a person, who extended the B1 and then chose to saty in US till match and applied for H1 from within US and never left US during his residency for fear of what u hae mentioned.

2 years ago, I did hear people were not allowed entry into US at immigration in JFK and Chicago, (one of them is my acquaintances) by the imigration officer despite of valid J1.. and the reason was that why did u extend ur b1/B2 earlier... and for some reason it is absolutely legal for the immigration lawyer to cancel ur visa on US entry if he feels it is not approproate.. but thsi was 2 years ago.. do not know of whats happening nowadays.

I have read something about this. It is y understanding that even though you have an appointment date for the extension of your stay permit, you should not remain in the country once your I94 expires even if your interview is the next day. That'll will create more trouble for you than just applying and being granted an extension. About the extension creating problems, I've heard both sides, of people havng problems and people not having any...
