I finished up step 1 and am currently doing my clinicals. However, i am starting to think about residency which i should be applying to for the 2010 match. I have a misdemeanor on my record for assault due to a fight when i was 19 years old. I am 27 now and my record has been clean ever since. Will this reflect negatively on my residency interviews or will it come up in a background check? For those you that have applied to residency and gotten in please offer some input as to what the process involves when they do a background check. I mean, its not like i killed someone, just a regular fight kids get into on the streets. Please help!!!

I'm not sure about this and i'm sure you won't find many people on here who will know...I know on the ERAS common application, they ask if you have committed a felony...I don't think they ask about a misdemeanor...of course the programs might be able to check themselves about any police record...

thanks for the input. It's good to know that they only ask about a felony on the ERAS application. Someone told me that earlier today as well. As long as i get to the interviews and if it comes up later on for instance after the match, then I'm sure i can explain it and hopefully they will overlook it. I just don't wanna lie on the initial application and have it turn up, which would obviously not be a good thing.

For all I know the background check is only done in California to get the PTAL and only includes problems you had with the law in the US, so if this fight happened in your homecountry I don't think they will care much about that. I might be wrong though but this is what I have seen. Take care and good luck!

From reading the initial post, I'm pretty sure this fight didn't happen in his home country. He meant he got a misdemeanor in the US...

I think you can seal your file, once it is sealed you have the legal right to deny any history related to felonies.. It was a fight in a bar, well I guess you can seal that easily with the help of an attorney.

I didn't know someone could seal their records. That would be awesome and i'd pay whatever i needed to get that done so i don't have to ever explain this. Since it's a misdemeanor, it shouldn't be as big of a deal but i am from california and i plan on doing my residency here so that is definitely something i need to look into.

If i were to seal my records does that just allow me to deny the misdemeanor or completely clear it off my record if a background check is done? I mean, even if it's sealed and a background check is done that wouldn't do me any good if it still pops up.

Yeah, i wish this had happened in afghanistan. For all i know, they don't even keep records there and something as simple as a street fight would be the last thing the authorities there get worried about.

well you should contact an attorney for better advise, but once your on file felony is sealed you should be cleared of any upcoming problems...

It is possible to have it "sealed", "removed" whatever. especially if it's a minor crime committed when you were young. You do need to contact an attorney though for him to advice you on how to proceed with it. Then once it's done, you don't have to mention the history ever again.

did u have any prob with visa...they will check it for sure when u apply for visa...i know a guy was denied visa
cause he had a case in the court for trespassing(which obviously he had no clue about)...well u got ur visa then i think it wont be a probsmiling face

I am a U.S. citizen and been living here almost my entire life so i don't think i need to worry about visa issues. But nonetheless, i wanna get this record off cause i don't even wanna have to talk about it if it ever comes up.
