I am wondering, if someone has an idea about legality of hiring people who need visas and excluding US citizens and green card holders? I know programs are allowed to offer non immigrant visas only if they do not find US citizens or a GC holder to fill these positions. Any idea?

I copied this from the USMLEForum... its unbelievable to me that someone would actually think of doing this...
I am appalled and sickened that someone will sink so low for a position...
We are all IMGs together until you get a position over me. Then I will f@#$ you and all like you - I guess this is his position!
anyway you slice this its wrong!!!

In fact the rule he/she is mentioning does not apply to Institute of Higher Education (universities and hospitals offering post graduate medical training) for positions of education/training... They can choose the most appropriate candidate according to their selection policy without bias.

If you go by numbers USA give more positions in NUMBER than compare to US or green card holder.
If we go by % then it will seem close but when you break it down by numbers IMG with no papers get about 5,000 positions compare to IMG with papers that get about 1,000 positions.

Now the following is my personal opinion:
If a person with no papers seems to be more qualify then US IMG, I do not see the problem with giving the position to those IMG with no papers.
I'm a US citizen and have a PASS in step1, if they give a position to someone that seems more qualify than me and that has no papers,
I TRULY DO NOT HAVE APROBLEM WITH THAT.
I just wish a program love me so much they offer me a premacth, snd I'm open to do any specialty and commit my self to finish the program if they give e the chance.

CocaCola, I think you are overreacting on this one...I think he was simply asking a question about the legality of the issue. Even though this law doesn't apply to residencies, there are some fields where institutions are obligated to take Citizens and permanent residents over applicants that don't have visas.

i don't think i am overreacting at all... i am also a citizen, so this doesn't affect me... whether its a 'sueable' issue or not isn't the problem for me... i simply think morally - its jaded!!!
