I'm an IMG from India.I've cleared step2 ,step1 is in April 08 and CS in June08.

My family got US immigration in F4 category recently and has already moved to the US.I was not eligible for the immigration under that category becuse i am above the age bar of 21.but my parents will be applying for my immigration now as they've got the green cards.Noone knows for sure how long it will take me to get the immigrant status....

what shall i do?what visa should i go for,H1 or J1?i'm really confused about this...... does the fact that my family has immigrated to US and there is no one in India give me a ground for J1 waiver?if i'm fortunate enough i might get a immigrant visa by the time i finish residency,but if that happens will my ongoing visa status H/J have anything to do with that?

i know many of you might think its too early for me to get into these visa issues..... but the reason i'm asking is if i must go for the H1 i need to plan accordingly about my step3 also.

some one please help.....

i think you should plan to get an H1b to strengthen your immigration application. GL!

If you join residency on J1, 2 year home country rule will apply (even if your family ties immigration petition will be due to be processed) and to you will not be able to contest waiver based on family hardship... as you are adult and you can manage your self in your home country for two years... by the time you finish your residency and have kids, wiaver based on hardship to your kids is still possible but not a sure shot.. Having H1 for your residency will solve this problem nad you will be able to manage your own immigration petition after completing your residency.. Now having h1 for your residency will not help your application for immigration through family ties (your parents)... Currently these petitions take long time.. you know how long did it took for your other family members files to go through.. No matter what, I would think you should rather choose to join residency at the earliest possible time (on J1 if required) as wasting a year or two will be like 2 year home residency anyway.

just one more thing,as i told you i will appear for CS in june,do you think i will be able to manage step3 after that and be able to apply for H1 if i aim for 2009 match itself ......how long it will take for me to prepare for step3...... if this could be feasible i can try for a H1 and not waste another year too.

wow..my cousin has the same problem...now that u have applied for immigration u u wont get a visiter B1 which u def want to visit usa fo step cs....my cousin is havin the same prob...please consult a visa attorney...my cousin was rejected for a visiter visa (twice)...h1/j1 is sponsored buy ur employer when u get a residency..thats is still a long way
