Yes U have to get a waiver if you have 2 year rule. It is not difficult, it is straight forward and simple. I Have done it my self without a lawyer ( I had it in 3 weeks from applying - and no - i didnt married US citizen).

http://www.travel.state.gov/visa/temp/info/info_1... http://www.cgisf.org/visa/nori.pdf maybe my geography is a bit wrong ...does Mayo clinic come under the area of operation of the consulate in San Francsico. If not use the form from the appropriate consulate http://www.state.gov/documents/organization/80024... End stage of your waiver application.....I think ....I am bit drunk .......cant think too well as I used to ...You know alcoholic encephalopathy......Hic.... ....Hope to cath you later Karusmle ....ooops catch you later ..not cath you.... Oh and by the way a tip.......when you interview project yourself as an honest and straight forward person. Thats all they will be looking for.....Good luck my friend.....

J1 waiver is not very difficult to execute but may become frustrating if things move slowly in your home country... most of the time is lost in obtaining no obligation to return to india (read home country) certificate....I have done it my self and everyone can do it without help of a lawyer.. Now big thing is- if you want to do residency on J1 clinical visa after being on J1 research visa, it is a long process.. basically does not fit in to match in march and residency start point of July schedule... it usually takes 6 months atleast ( my application did not move for 9 months and even at that point Dept of state asked me if I was still interested in that particular position) So choose wisely.. obviously you can get h1 for residency after you get waiver for your j1 research visa... another fine point... you can not get extension of J1 research visa after you get final waiver from USCIS ..

The 2 year HR rule depends on the area of research and home country.. it can be checked in a list published by Dept of State..http://exchanges.state.gov/education/jexchanges/participation/skills_list.pdf If your friend is from another country (Western Europe) 212 (e) may not apply to him/her for medical research.
