i think a consultation with the head of the institute or the director is the way to go because as stated in kap med ethics book ONLY A PT CAN GIVE CONSENT AND NOT HIS FAMILY
HOWEVER IF U FEEL THAT U WANNA GO AHEAD WITH SOME PROCEDURE AND THE PT IS NOT FIT TO GIVE CONSENT THEN CONSULT THE HOSPITAL INCHARGE
court orders will coz unnecessary delays
and u cant say that appendicitis is dangerous coz u know conservative mx is
possible
also WILL A 88 YR OLD MAN BE REALLY FIT FOR ANESTHESIA
not if i were an anesthetist

in emergency situations to save life -u need no consent.
if it would not have been an emerg situation wifes consent/court orders would hv been sought.

i came across a question in UW, which asks about a situation where a man refuses an emergency blood transfusion to his wife and child. the answer states that wife cannot be transfused, but for child, parent cannot withold life saving treatment.

SO what happened to " no consent in emergency"???

the rule that consent is implied fits here

the only possible distractor would be ASK THE WIFE FOR CONSENT but look at it this way... in case the wife says NO to your askin her...what will be your decision??? obviously you will stil perform the surgery...

so PERFORM THE SURGERY...

well the question mentions the presence of wife then taking consent from the wife is the appropriate answer...........D.........
