If the patient was 18yrs old then the patient shud be asked for informed consent. Informed consent in cases of mental retardation such as Down syndrome the degree of cognitive function impairment. She is considered a minor, which confused me to obtain the consent from the father or the husband, so i took a guess.

there are two things in this question which need to be considered

mental retardation
amancipation

now the court decides if she is legally competent to give consent..if yes then the patient herself.if not then the next of kin that is husband.
correct me if i am wrong

it's either the patient or the husband. the father is out of the picture since the husband came in it.

she needs to have her mental competence assessed first.

and, of course, if it's an emergency, you don't need either. the qn is not very clear....

When a patient is mentally incapacitated, medical decisions must be made by an authorized person acting on the patient's behalf. Such persons are called surrogates. Traditionally, next of kin have been considered the natural surrogates, and clinicians have turned to family members for their consent. This practice has been tacitly accepted in Anglo-American law but was rarely expressed in statutes. In recent years, many states have enacted legislation that gives specific authority to family members and ranks them in priority (eg, first spouse, then parents, then children, then siblings, etc.). The durable power of attorney statutes also provide for a surrogate or designated decision maker, who supersedes any other party, including family members.

The emancipated minor is a young person who lives independently of parents, physically, financially, or otherwise. Married minors, those in the armed forces, or those living away at college are considered emancipated. They may request treatment and be treated without parental consent.

since nothing has been said abt the mental status of the pt we souuls assume him to understand and besides he has married so he clearly is not mentally chalenged.

so who said that the downs syndrome causes mental retardation all the time???

usually the range of IQ is from 60-80 or above.. who can know very well the consquences of surgery... so PATIENT wud be teh choice

patients consent....as she is married which showz that she is not mentally challenged.....

Lets say the patient was 19 and single. You'd still ask the patient for consent , right? You cant asume the patient has poor cognitive function and is unable to give consent just beause she has Down's. Now, here, the patient is a minor but then she is married and marriage emancipates. So, the patient gives the consent.
