Is a patient legally punishable under law if he hides facts regarding his uncured/partially cured communicable disease-acute or chronic from his doctor in the fear of affecting his job opportunities ?? i have faint memory reading about it somewhere but is it important for boards??

no he is not. As for as the doctor's action goes, he has to use universal precautions in each and every patients irrespective of his nature of disease.

criminal court he is not punishable. but in a civil court he could have issues.

Gr8doc ,Hope i was clear with my question.. IF patient visiting for a different reason like sore throat, hides his or her communicable disease status as serious eg as partially treated GU TB from his or her doc for fear of affecting job opportunities , does the legal law or medical ethics law sue or punish the patient for hiding facts as it could affects the community as a such... Do u have reference ?? Confused !

Like everyone else, Even I have these faint memories of learning it somewhere that you can not take any legal actions against such patients. The most you can do is refuse treating such patient stating "Breach of Contract". Hope this makes it little more clear.

Kochs - I think the doctor "assumes the risk" by being a doctor, so the doctor probably can't sue. If someone else can establish that he or she was injured as a result of the sick person's actions, and that the sick person's action's weren't reasonable, then there might be a cause of action there. I am a lawyer and cannot really answer this question without doing a little more research. Its not that clear-cut. That means that they will not ask this on the exam. Don't waste your time. I had a ton of ethics question on my CK and nothing even close to that. I did all of Kaplan Qbank and all of UW Q bank and saw nothing even remotely close to that question. They are not interested in having you try to sue a patient or make the patient responsible for stuff - they just want to know how YOU handle things. So what they CAN ask is if YOU can hide a disease from your patient (You cannot) and if you need to remove contagious staff members from having contact with patient (You must). If the PATIENT is infected BY YOU, then YOU can be liable. Hope this helps.
