hi misty,

This is in relation to the opinion u gave me on j1 short term scholar visa..i have a question...it is...
how long will it take for me to receive the advisory opinion from the DOS after i send them the ds2019 forms? this is because the time is getting shorter for me as i have to go to the visa interview also..will be receving the forms in a week..

can i schedule an appointment with the immigration attorney and discuss this issue over the phone? this is because i am in india right now...

well the DOS website says thay they take 4-6 weeks..however delays from their side are well known ....and I have heard (from forums ) a maximum of 4 mo from their side.

also this 4-6 weeks time frame given on their website...was in 2005. Maybe they didnt update after that. what I can say is....to avoid frustration...just think that ur case will take 4 mo and act accordingly. if u get it earlier....Great smiling face It shldnt necessarily take 4 mo...esp if u r case is simple. as i said..4 months MAXIMUM.

I know that Law offices of Sheila Murthy do consult over fone.(google murthy forum) I even have their charges somewhere in my mailbox for a 20 minute consult. Dont remember the charges right now. Try that. I guess many immigration attorneys consult over fone. U can even try asking Law offices of Rajiv Khanna.I dont know how much they charge.

frankly speaking...i wonder if anyone can really tell u how much time will DOS take in anyone's case....i dunno if an immigration attorney will be able to answer that. So do keep in mind dat, if in case u need a waiver...h1 wld be possible if u are able to get a waiver in time. Go ahead if u are okay with a j1 clinical.if u want h1 wid no exceptions, for ur residency, think twice.

but I thot u had asked whether u can get a j1 clinical right?

if the 2 yr rule does apply then how long will it take for me to get a waiver if i submit them the no objection from the govt of india..

who is the one from whom we r to get this no objection from?

one more question...

r u sure we can contiue residency on j1 after doing observership on short term scholar j1 visa...

saw ur post stating that u have seen it on the ecfmg website..but cant find it out..

i have also found out sheela murthy forum and planning to take an appointment for my questions also..

firstly:

DISCLAIMER: I AM NOT AN IMMIGRATION ATTORNEY. JUST POSTING WHAT I KNOW.

aaaah waiver...oh what a lengthy process.... i will tell u the steps in short ( warning: i havent been thru the process myself.....so u might want to get more info and not regard this info as complete....i am posting here everythign to the best of my knowledge..if i dont mention any step...i am unaware of it right now)

1) once u go to US...each state in Us comes under a specific CGI (consulate general of India)....depending on which consulate serves which area...CGi @ SF, houston, and 2 more (dont rem). U will be uner one fo them. find it out for urself.

2) visit there website & find out what documents need to to be sent to them for some attestation purposes. u send them via post. (dunno if u can get it earlier if u go personally or whether they even allow that.....maybe they do. I had once been to CGI houston for some other purposes and they had given an attestation in one day...this was for totally nonmedical matter. I am just giving an example) Then they will send u attested copies of the documents u send them. basically its some kinda application stating u need NOC for waiver. by post...this process takes a few days

3) u send these documents to ur homecountry ( i am stating depts for India) - 3 departments - MHRD Delhi, Home ministry of the state u are from and regional passport office (which issued ur passport) each wil issue u a NOC. from what i have read on forums ...usually the first 2 give the NOC to u....while the passport ofice send it directly to the CGI. however this info is from forums. this is the process which takes the longest time. by long i mean really really long. unless ur uncle (or shdl i say aunt) is president of India or u are the son of a don ( hope u understand what i mean- contacts is what u need to get this done faster)

plz follow up or make someone from ur hoemcountry follow up on these departements. regional passport offices are known to create a mess and since they send teh NOC directly to the CGI in US...they dont really bother to inform u or provide u witha copy of the NOC. get a copy of the NOC from all depts if possible before they send it to the CGI. this is for ur satisfaction

4) when these 3 documents reach the CGI...the CGI issues a waiver certificate...which goes to washington ( I dont remember- but i think it goes to the indian embassy in washington and then the embassy itself forwards it to the waiver review dept of the DOS in wahington itself..i guess after this u can track ur application online...the status of ur application i mean)

usually DOS takes 4-8 weeks to process the application and issue a waiver. delays are occassional....but the usual trend is- delays are usually due to NOC and not DOS.

now if dos approves ur waiver , ur online status wld appear as "favorable recommendation" after that...in a few days...u wld get a hard copy of dat favorable recommendation. Usually after this the INS/USCIS issues awaiver in 99.9% of cases. so if u intend to petition for h1 ..u can file after u get the DOS reco...however plz understand that u get a visa only after the INS/USCIS issues a waiver....& when INS does dat...u get a hard copy of that document too from the INS....the DOS directly forwards the recommendation to the INS and then INS issues u the waiver. Your job is mostly done when u submit ur documents to DOS and ur wait is almost over when DOS issues u a waiver...as i said, INS waiver usually follows.

when u send ur documents to ur homecountry for the NOC..make sure u get a case no for ur case online. this takes a little time & hence if u do it before u get ur NOC from ur homecountry it saves u a few days.basically its just paying ur fees nad submitting an application.

make sure u send all appropriate documents alltogether. any missing document and ur case wld be delayed further. sending all documents wld save u further unwanted and shocking surprises and DELAYS.

this is in SHORT! get the exact departements and addresses from the respective CGI or ...I dunno where...the CGI shld help....but u know/will know how they can be. smiling face

regd ECFMG...the website has MANY webspages there under ECFMg EVSP....please go thru EACH AND EVERY PAGE. u shld find it. if u are unable to...well as i say...plz dont trust me....call up ECFMG. they are ur best bet.....its ur career..dont trust any strangers on forums. take everything wid a pinch of salt.

Although i am sure it is there on ECFMg website. read everywhere. it is mentioned in only 1 document...dont rem which one.

i just have one request..we all know how ill informed we all are regd ths j1 issues. if u go thru it urself..i request u to post ur experiences and help ur friends here.

any experience good/bad ...plz post it so that our fellows know beforehand what to expect when.

dont thank me my friend...I would be happy if u just share ur exp wid this forum. I had a hard time to get this info. spent months to gather this info. make it easier for our fellas. Having information helps us make a timely & correct decision. and hence make best out of the opportunities we have.

I hope i see ur post after a few months here.

i did go to the embassy for the short term scholar j1 visa for the observership in the dept of surgery and they told me that the 2 yr rule applies even i do it for 6 weeks,,even though i am funding it my self..they told me that i am working in a dept which falls in the skills list, even though i argued that i did not attain much skill..it did not help me..but u r the one person who helped me out a lot regarding this issue and would like to thank you.......in the end i did not accept the visa and came back, even though he was will to issue me ..as it would comprimise with my residency plans..

Aspirin, it is good that you refused for J-1 with 2 yr HRR. Even after waiver, which anyway takes almost 6-9 months or even more, your chances of getting a residency on J-1 ECFMG visa would be dismal. I have gone thru' this and I know it is best be avoided.

ya ..it best avoided ..even i feel i did the right thing...
so plastic surgery...did u finish general surgery or wat? wat r u doing now? i applied to surgery for 80 progrmas but received only one interview..

I have done surgery in home country and looking for clinical fellowships. Am not interested in residency.. just want further training.. I wish you the best.. ususally surgery programs take longer for application evaluation and especially Uni. programs take even longer..
