HI EVERY BODY, I Happened to get a chance to do an observership in an univ for 6 weeks and they said i have to get a short term scholar visa j1.. the funding is completely by myself and though the department in which i will be doing the observership is listed in the skills list of my country...i want to know if the 2 yr HRR applies to me, as the duration is only for 6 weeks and i am not getting any skill by observing(i am not supposed to touch the patient). can i ask the visa officer if the 2 YR HRR applies at the time of the visa interview? if he says yes what do i do? shall i come back stating that i dont want the visa? this is because i am going for the 2008 match and it will comprimise wit my plans.. will the visa officer in the embassy be convinced that i am going only for an observership and spare me of the 2yr HRR. Shall i contact the immigration lawyer for these doubts.. if the 2 yr HRR doesnot apply,can i join the residency with h1 visa after getting the short term scholar j1 visa. thanks in advace to all those who can help me... knowlegeable people r requested to throw some light on these doubts..ur opinions r aprreciated.

well dat is a bit complicated. I dont think talking to the VO at the consulate during ur IV will help u. Although the skill is mentioned in ur country's reqd skils list, u will not be acquiring the skill as an observer... maybe u can try sending ur form to DOS for an advisory opinion. as regards visa, when u go for iv & if they stamp the 2 yr hrr and u dont want it....as far as i now...as long as u dont enter US on that visa...u are not in dat status. Just a j1 stamp on ur passport does not mean u are j1...u have to enter US on j1 and get an I-94 for dat visa. Only then are u on j1 status and u will need the waiver for 2 yr hrr if reqd.however, consult an immigration attorney for this one. send ur forms for an advisory opinion to the waiver review dept of DOS as soon as u receive it. They are the final authority afterall. If they say u dont req a waiver...doesnt matter whats on ur DS2019 or visa...u dont req a waiver hope that helps

hi misty, how long will it take for me to receive the advisory opinion from the DOS after i send them the ds2019 forms? this is because the time is getting shorter for me as i have to go to the visa interview also..will be receving the forms in a week.. thank you very much for the reply..awaiting ur reply..

Aspirin, even if you will get waiver or not be subjected to 2 year home country rule,,, changing from J-1 research visa to J-1 clinical (ECFMG) visa is a lengthy procedure. It takes from 6-9 months. Believe me, you will not have a chance of getting residency on J-1 after being on J-1 research. This is not to scare you but giving the right advise. Anyways, your chances of H-1 remians open after J-1 research visa.
