Hi bbb,
My status is that I have given all the appls and marked H1B, J1 and EAD. I will not accept a J1 under any circumstances. I have not yet applied for EAD but am thinking of doing so in oct. At the interviews, is it better to say that I'll have an EAD by the match or is it too much in the nick of time now to get the EAD on time for that? Should I try and get an H1B instead and not apply for EAD now?

I am here on B1/B2 now and it will be an adjustment of status to EAD. Would u also know if after i get the EAD can I go to India after the match and return for residency? Or will I be stuck in this country till the process is over? Thanks.

It would be a wonder, if the PD doesnt get confused by the whole information you have providedgrin.
BTW I was always under the impression that EAD is applied only after H1.....how are you able to do it on B1/B2?confused

I forgot to mention in my note. I meant adjustment of status after marrying a US citizen not directly from B1/B2.

Then why did you indicate that you would accept a J1 visa? The first thing you better do when invited for an interview is double check that they can and will sponsor a J1 visa. Otherwise you will be one of the 30 persons we interviewed who asked about an H visa (even when our web site, emails and invited states that we would only sponsor J1 visas), and we told them that we don't sponsor them. They lost all interest in the rest of the interview day and a few left early. But they wasted their trip to see me, and wasted our time interviewing.

EAD is always better for residency positions because you dont require any visa sponsorship. Having said that getting an EAD even on an adjustment application marrying a citizen can take at least 4-5 months at the earliest I believe. So when you go for interviews and tell them about EAD have that in mind. Also with EAD you can travel but you need to have an Advance Parole...(AP)....you need to apply well in advance since it takes forever to come.
