Hi all

I'm an IMG, currently on a H4 visa.
My husband has just submitted the documents for green card and was told it would take about 3 months to get the EAD..thats around October.
I am planning to apply for match 2008 in pediatrics and need some advice regarding visa issue.
Should i wait till October, ie after i get the EAD to apply to programs or should i apply earlier stating i already have the EAD.
Or should i apply in september stating i need H1b and then when i get the EAD change my visa staus?
I would appreciate some advice from people who've experienced a similar situation.

Programs will want to know what visa you will need to work in July 2008, not what's going on in the interium.

Dear Kavi

Never lie about your visa status - it will catch up on you. I don't know how you can be sure you will have an EAD in 3 months - immigration things take as long as they want - there is no such thing as an average time ...

We are an extreme case but it has taken us 4 years and plenty of immigration attorney dollars to get our EAD. I have had my own H1b visa for all of this time.

Basically, be honest in your application and hopefully if you do get your EAD by the time interviews come, you can tell them - although it is somewhat of a Catch 22 situation because without EAD, you will need either J1 or H1 visa and many programs will automatically exclude you when considering who to invite for interview. I delayed my application by one year just to get the EAD in hand.

What are the exact words on the CAF where it asks for visa?

guys, I have talked to an attorney and she told me that when you apply for EAD Immigration has to reply within 90 days!!! meaning that no later than 90 days from receiveing the application they have to either give it to you or reject (which would be a rare case if you had all the proper documentation).

to bbb: there is a section on CAF where they ask about current visa status if you are not an US citizen. There is a big checklist where you can choose from 15-20 (all possible) visa situations.

From a program point of view - I look at it different. I look at that spot as "what visa will they start work on"

well, there is both on CAF- current status plus expected visa when starting residency. And for both there is all diffrent options(B1,J1,H1,EAD etc...)

hi all,

Iam sailing in the same boat. I have submitted my greencard papers along with my husband. My lawyer says it takes about 2 months to get a reciept and 6-7 months from then on to get the EAD. So is it that since i have applied for GC I would not be given a J1? if any one has any input please let me know. Thanks!
