hey bbb has ur program filed for h1 for residents or still completiting paperwork. my program will take a few more days.

An attorney office files when materials are received from the applicant. I'll stand by the fact that two weeks isn't long enough.

We waited last year until the middle of August for two residents on an H1b visa. Yes, we used premium processing.

Here is some official info. It should be 15 calendar days, but based on BBB's experience, it does not happen always that way. I am currently on an H1B for Research and without premium processing I received the approval notice two months after I submitted the papers to the International Office of the University I work for. Best, ngt.

http://www.uscis.gov/portal/site/uscis/menuitem.5... How Do I Use the Premium Processing Service?

What is it?

Premium Processing Service provides faster processing of certain employment-based petitions and applications. Specifically, USCIS provides 15 calendar day processing to those who choose to use this service or USCIS will refund the Premium Processing fee and the relating case will continue to receive faster processing.

The processing period that is used to determine whether or not USCIS meets the 15 calendar day period will begin when the current version of Form I-907, Request for Premium Processing Service, is received by USCIS at the correct filing address noted on the form. Within the 15 day calendar period USCIS will issue an approval notice, or where appropriate, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation. If the notice requires the submission of additional evidence or of a response to intent to deny, a new 15 calendar day period will begin upon the delivery to USCIS of a complete response to the request for evidence or notice of intent to deny.

hey moozy can u book appointment before u get 1797

  #13

It's been 3 weeks since my PC told me that she sent my application to the person in charge of visas... I hope to receive something soon, some of the matched guys in my hospital are already attending the morning reports.

You will certainly need the I797 for the appointment, and at some embassies your waiting time will be shorter than the one for tourist visas.

It is better to book the appointment once you have the I797

To book the appointment, I just need to make the phone call. I will obviously need the I 797 on the interview day with complete aplication.

Ishter.... My PC had sent the paperwork to my lawyers in last week of march .... but my case got filed on 20th April.. I dont know the reason for the delay.. but I felt that my time got wasted ( as I had signed a prematch and had paid the visa processing fee to the lawyers before the Match day and my applications stands in the matched applicants pool anyway.. so there was no point in rushing things). I hope I hear something by early 2nd week of may and then will apply by mid may at embassy.... hoping that the H1b gets approved.

Did the lawyer have to wait for your license to get approved?? There is all sorts of things in the background that you can't see and don't know what's going on. It's not wasted yet......

hi guys,

is it faster when some one try change of status from B2 to H1 .....?? what are the pros, and cons compared to get it stamped from a US embassy?

thanks

  #19

hey moozy maybe it was not a delay. the program takes some time in signing docs.

  #20

My licesning was complete in February also and all the documents were recieved by lawyer in March... I am sure there must be a good reason for the delay..

I think I was overwhelmed with the fact that since I have signed the prematch and have all paperwork ready, my formalities for visa will be done sooner... may be the lawyers had some lenghthy paperwork to do also..

Just waiting for premium processing to speed up things.... I have not rcvd any tracking number as my lawyer told me that she has not head anythung after the filing of H1B case.

I just got my tracking number for the application. It was recieved by the USCIS on 25th april. With pemium procesing hopefully it should be dealt with sooner but at present they are procesing applications recieved on 13th Feb 2007.

Fingers crossed

Yesterday I contacted my PC again, and she was surprised that I haven't received any notification about my visa yet... She encouraged my to contact the person in charge and I found out that my application has not been filed yet.... shocked

So, it seems that I won't be able to travel anytime soon... sad
