Hey everyone. I am planning to do a few months of research in an institution that sponsors a j1research visa starting september 07. Am i able to switch this visa to a H1b visa if i get a residency position in the 2008 match? Ive spent about 6 hrs online looking for info but to no avail.

If the answer is yes and i get my J1research position in September 2007 and Match and file for switch to H1b in March 2008, will I be able to make the switch before July 2008?

Apurva i think you were in this spot sometime last year. what have you learnt? should i just hold out and not do research or should i go for an overkill on J1-research and try for h1b when time comes.

Department Of State (DOS) should waive your J-1 before you can change to another visa category.

I think you can work as a volunter researcher, i meant you won`t be paid yet u will be part of the research, and the next match you can go for h1. But once you commit to j1 changing to other visa is tough job, but i am not sure abt the details of DOS.

This is the question, I asked in this forum couple months ago, before I came in US. I had to research all the possibilities and learn all the rules regarding J1 and H1B to get appropriate status in this country, which would meet my requirements. So, the answer is brief and simple. If you will be financed by US or your government, i.e. would work in university research lab, or get scholarship or anything like that, most probably you will get J1 with 2 year home residence requirement, which means, that after you finish your program you HAVE to physically reside in your country for at least two years. There are some ways to waive this requirement once you have it, but it is definitely impossible to switch from J1 with 2yr/h/r/r to H1B. However, if you get J1 without that requirement, you can do anyting that you want, I mean, change visa type or stay the same visa. This happens when you're financed by private sector or nongovernmental organisation/foundation. So, it really depends on funding source. I had to go through hell until I understood this, and there was nobody in the world that could answer to my question and give better idea of my particular situation. It really depends on your situation, try and find out if they're able to issue visa w/o this requirement, but I am not sure how you would ask them, as the immirgation officer, who is issuing the DS form for you would not be aware of these details, as how happened in my case. Look at your DS-2019, there is section on the right botom of page, you have to waive the 2 year if they denote on the form. if nothing is on the form, feel relax you can change to whatever you want.

My answer is to check with an immigration attorney. There are all sorts of rules that you can do this, not do that. An immigration attorney would be your best bet.

WRONG.....I joined a research job with no pay/ funding & still subject to 2 yr requirement cos the field i was working was a shortage skill in India. As a matter of fact all research fields are skill shortage in India. Now Im formally applying for a waiver. DONT EVER TAKE J1 research.....the worst visa to change to residency.

I agree with fox, I have never heard of anyone getting a J1 visa without the 2 year requirement. Be very careful before you decide on this. I don't know if Apurva did his research on J1 visa but he is currently doing residency on H1.

Edit; I just realised its a 3 month old post. Still it would be useful to get more inputs.
