Query?My Husband has got waiver job and I am participating for this years match.i have passed step 3 ,am I eligible to recieve H1 if I get matched.My Husband will be on J1 visa till June end.My friend is on EAD and her husband is an intern,If she gets matched can She start residency on EAD and in the second year apply for H1.

Aha..

1. If you passed step 3 you can be eligible for H1-B IF your INSTITUITION sponsors you for one. You can't get an H1-B through your husband. H1-B depends #1 on instituitiion and wether or not you passed step 3. (Since you did it only depends on the YOUR future employer)

2. If your friend has an EAD (aka employment authorization document) she can work as a resident, even better she doesn't have to get an H1-B which is just a restricted work permit vs EAD which is more like a non-restricted work permit. In any case if worse comes to worst answer#1 applies for your friend, too.

Thanks a lot Mufurc.I just wanted to make sure can some one get H1 visa in the middle of residency,if program is ready to sponser due to the circumstances (as in Question No.#2).
