Hi all---I have an EAD based on filing for my GC. It expires in Dec'07. I understand that I can renew it. Can somebody tell me if I can start my residency(which is usually a 1 year contract) on this EAD? Does anyone know who is doing residency on an EAD? Need to know soon coz will have to take step3 ASAP if I cannot start residency on an EAD...

Hello, I am in the same position. Yes , you can . No need to take step 3 . And with an EAD you can't apply for H visa . Good Luck

You can do residency on EAD - no need for another visa.

Do programs have reservation while taking people with EADs? I mean is EAD a universally understood phenomenon by the residency positions or do we need to explain specificially for some people.....I know many places that do not take IMGs are very unfamiliar with these rules and documents....BBB any input would be appreciated

I like to think of it as a pre-green card. If a residency is familiar with IMGs and visa, etc - they know that an EAD is a good thing.

I have a question for BBB or anyone else: I know a guy who is using a EAD for his residency in a community based hospital now, but he got his EAD 2 years ago when he was doing medical research in a university. Is it OK for a program to renew his EAD every year? (he changed his field, or not?) Another friend of mine wants to know if it is legal or doable for her future Match application. Thanks a lot for any insight.

That's a question for an attorney - I don't work in research. EAD is still a working visa, nicht wahr?

Its not the program that renews EAD but the applicant. The EAD for a green card is given for the candidate not for the company you work for so basically its a permission to work for one year and then renew every year.

I see. Thanks. But my friend who works in a University, asked if she would be able to use her EAD during the first 1 year residency in a community based hospital. I told her not to take a risk of losing her final Green Card, but I am concerned that I might give her the wrong information.

It depends on what cetgory she has applied in. If its a self petition then she is incharge of the EAD and it does not matter if she migrates to a different job as long as the job is not radically different from what she originally applied for (for example she cannot of course start working in MAcy's after working in a University). I think if she was i research or sumthing in a UNIV then she will be fine moving to the residency....I am somewhat in a similar boat. IF HOWEVER she has applied via labor certification then her EAD is tied to the UNIV until the final GC comes through and she needs to consult a good lier (sorry lawyer) about her sitiuation.....always better to be safe than sorry....

bikerdoc, if an ead is approved but not yet received in physical form do you think there is a problem in starting resi?

Thank you very much, bikerdoc. I will let her have a look what you posted here. I believe she applied for the EAD by herself (as a postdoc); she thinks she'd better try some community based hospitals next year for the reason of low scores. I have no idea on this issue; just hope all of us can make our dream come true earlier...

Hi Seri, If you EAD is approved you SHOULD definitely receive it before June 21st (or whenever your starting date is). It usually does not take more than a few days for them to send the EAD. Actually I got it within 10 days of approval...so yes You will need the physical card to prove that your EAD has been approved to your empoyer. Or else you may be able to use the confirmation I-797C receive from the USCIS stating that your EAD has been approved but I am not so sure on that one......you might consult a lawyer or some immigration forums.....good luck
