Hello Friends.
I hav got prematch and hav applied for H1b....the approval hopefully will come in few weeks.
1. In my visa petition, I have mentioned that I am single (no spouse).
Once I get H1b approval, I plan to go back to my country for H1b stamping and will try to get married. Will it be easy to apply for and bring spouse to USA on H4? or what would be better option to bring her here? and what will be the process?.....Considering my marrital status as "Single" on my visa petition.
2. Also, I hav heard that spouse can not work on H4. Is that true? Will spouse need to get J1 or H1 to start job/residency?
3. Considering my credentilas as average(Step1+2+3 scores in 80,s) and IM Community program with no fellowships, what are the options/ways for me to get into a fellowship?

ok I know a lil bit about your first two questions & none aboutthe third quetion

1. Since you applied for H1 visa as single, The best route will be

a) to take your wife on B1/B2 visa along with you to USA & then filing the petion for an H4 visa, with an attorney help. That will cost you something around 600-1000$, she can get her H4 visa stamped whenevr she visits india next time. OR

b) After marriage & after you have been granted an H1 visa, she can apply seperately to the US consulate in india for an H4 visa, your presence is not required. she will require a valid marriage certificate, a few wedding pictures, a letter of sponsorship from you & Your H1 visa approval/form I 797. & your pay rolls (may be)

2. Yes you can't work on an H4 visa. yes she will need a j1/H1 to start a residency. She won't have a SOCIAL SECURITY NUMBER, but she can have a driving licence.

Basically i m from Pak. Regarding Q.1, which option would be better (a) or (b)?
Also, For option (a), is my presence in pakistan necessary for her B1/B2 visa?
is the chance of H4 approval equal for options (a) and (b) OR there is difference?
Just as another option, if someone on H1b (like me) gets married to U.S national spouse, what would be the further visa issues for me? Will H1b automatically get converted into GC after 3 yrs? or what would be the further directon for me?.....please give me information on this Q. as well.

1st, U need to have an attorney . Some programs have their own attorneys for visa processing, others ask you to find of your own( still they can suggest you those attorneys who have been working for their residens over past years)....So, ask the coordinator about the matter of Attorney.
Once you find attorney, U will sign a sort of retainer agreement with attorney.
U need to submit all possible documents to attorney U have :-
Steps scores 1+ck+cs+3, ECFMG certificate, medical school diploma, credential verification certificate/report from ecfmg, ecfmg status report, MSPE from medical school, transcripts, photocopy of signed contract, medical school exams scores (whatever document u have), photocopy of passport (front +back surfaces, 1st 2 and last 2 pages, pages of yr information and photograph, visa , I-94 card), medical license (if u have, whether here or from your country).

many programs bear the cost of processing H1b but depends on program....U will hav to ask the coordinator who will pay for H1processing. If U have to bear expenses then: approximately 1000 $ attorneys fee, 1000$ premier processing fee, and abt 700-800$ for other things(total abt 2800 $ )

Uptil here it wud take 1 week or so depending on how actively U proceed. Once U submit all the documents to atorney, he will send these/certain other documents to the program for further work. once program sends documents back to the attorney, he will forward all the documents and H1b petition to government agencies......if all the documents are complete, government takes abt 7-14 days to give answer of your visa application.....most often its the approval........by this time its 4 week or so since U got in touch with attorney.
Obviously if program has its own attorney and the proram is also quick in processing the documents then it may take less time.

Each State has its own policy about State medical license for H1b processing.

Amongst a & B Certainly B is the safest option. For her B1/B2 your presence is not mandatory/required. She can apply for B1/B2 on many grounds eg. taking CS/Step 3 in US or just for tourism purpose, for being with her husband for a short while. Chances of H4 approval are the same in both the choices, but in A choice, she will have to struggle for B1/B2. I mentioned (A) option for a person who already has B1/B2(before u marry her!)

If you happen to marry a US citizen then you can file for a green card after coming here on an H1 visa. Dont apply for a green card sitting in india cos it takes a very long time. I'm not sure how much time it takes to get a GC after marrying a US citizen, but what I know is you get an EAD number. For further information check this

Hi I have some Q's about H1B, for how many years the H1B will be issued? for the length of the training or just for one year since some contracts are just for one year at a time?

If you are in H1B you will be able to leave the USA, lets say for vacation during your training?

the length of H1B depends on the sponsoring authority. yes it could be for a single year or 3 years, But maximum length is 6 yrs. yes u can leave the country for vacation on H1 b, as a matter of fact on any valid/approved visa status, you can leave the country for vacation.
