usually you do need to be ecfmg certified. but like bbb said it depends on the prog.

a friend was waitiing for his CS score (and still waiting for it till now) when he was offered a prematch.

A friend of mine signed a prematch with step 1 scores only... for surgery... it was a few years ago, so things might have changed since then... My point: it is not impossible to get/sign prematch without ECFMG certification but you must get certified to start the training!!!!

not illegal. the program has the right to make the contract void if you didn't get the certificate so it is no problem for the program. usually they don't have a problem if you only waiting for CS and you looked presentable during the interview.
yet it is highly unlikely that you would get a prematch if you don't have your scores
