Hi I was reading the H1-B application process from www.uscis.gov in an effort to determine who should be paying the H1-B visa fees. I got a pre-match offer from a university and they told me that they would sponsor H1-B visas but I have to take care of all the associated fees. According to the "H1-B Data Collection and Filing Fee Exemption Supplement" which is part of the I-129 visa application document it states that: If the employer is an institution of higher education as defined in the Higher Education Act of 1965, section 101(a), 20 U.S.C. section 1001(a) OR If the employer is a nonprofit organization or entity related to or affiliated with an institution of higher education,as such institutions of higher education are defined in the Higher Education Act of 1965, section 101(a), 20 U.S.C. section 1001(a) Then the employer is ONLY required to submit the fee for your H-1B Form I-129 petition,which is $185. So I guess I have to pay all the fees and the new rule where the employer has to pay all associated visa fees are not really valid for university programs and non-profit programs affiliated with universities. Anyone have any other take on this issue?
