hi, im on L2 visa( dependent of a L1 holder). i came to US in oct 2005. would be applying for 2008 match or 2009 match in the worst case scenario. my question is , if i change my status from L2 to J1/h1 would i be able to stay for another 6 years or so or will the no. of years i have already stayed be counted? duration of stay with a L2 visa is 7 yrs.(3 yrs+ 4 yrs extension)...would i be granted a max of 7 yrs stay even after changing my visa status to j1/h1?

Sandra, Why would you want to change your visa status from L-2 (which gives you unrestrickted work authorization) to a limited H-1b visa? Your situation (having L-2 and option to obtain EAD) is the second best thing to a green card!!! As far as I know J-1 is not even an option for you since L-1 is a dual intention visa (imnmigration is optional) and J-1 is STRICKTLY NON-immigrant. It would be very difficult for you to prove that you do not want to immigrate into the US... On the other hand if I were you (or your husband, who is the main visa holder) I would apply for green card while on L-1. that is easy and if he is an excutive (i.e. L-1A holder) he doesn't even need labor certification so you can have a green card in about a year!! It doesn't get any easier! GC is a definite plus in the match!! I hope this helped. Good Luck! Mufurc PS: I am not an immigration expert this just my opinion.

Hi sandra, I had a question,can one take step 2 cs on an L2 visa.is it legal to take ?also can one do observership and participate in the scramble with the same visa status.

I believe its possible , and you might have no problem at all to take step cs with your visa status (L2) Its pretty legal . And for observerships, thats a question you should ask the programs you are applying for observerships. But most of the time you dont need specific visas, even with B1/B2 you can do observerships, i did it that way with my turist visa!

hi mufurc the main problem is my husband's is on a deputation here and his company doesnt process green card it would be risky for me to enter residency as his dependent coz he himself has no idea when he would be required to go back to india any ways, could u or any one enlighten me on how to obtain a EAD? thanks in advance
