schizophrenics can have lucid periods in between flares (hours to days inclusive), so if you as a doctor consider this patient is having some sort of hallucinations and bad symptoms and he or she needs an emergency intervention, he or she can be considered incompetent (but only in a situation like this). i F HE OR SHE IS IN A LUCID STATE, her right of desicion must be respected

I agree with frank 100. Assume that the patient is competent unless clear behavioral evidence indicates otherwise. Remember competence is a legal not a medical issue, so only courts can decide it. Behavioral evidence like suicide attempt, psychotic or no simple communication is possible. (Source kaplan lecture notes 2005-2006)
