Hi guys,

I am a bit confused about this visa issue...

If I am planning to work in America after my residency, isnīt H1B visa the best choice? If I get the H1B I will be able to stay in the US after residency and look for a job just like the GC holder, right?

And if I only pass the step 3 before I start residency I will get the H1B visa?

To start with, yes, you will need your step 3 results to get an H1b visa - and a residency that will sponsor it.

When you complete residency on an H1b visa, you will then need to find an employer who will sponsor your H1b visa and greencard (permanent residency). Now, if you get your H1b visa at a cap exempt institution, then you will need to get your H1b visa and greencard sponsored at a employer who is also cap exempt. And the same if it's not cap exempt.

Impossible? No, it's not. Easy? No, it's not that either.

Working in an IM residency, in the past couple of years, we have had 3-4 residents on H1b visas who have had to return to their home countries waiting 12-18 months for their H1b sponsored position to complete paperwork.

Residents on J1 visas, have not had to return home, paperwork is faster/easier.

Your choice - good luck.

thanks bbb for your answer!

sorry if Iīve got things wrong, but I thought you were obliged to return to your own country for two years after completing residency in America if youīre on a J1 visa? After what you just said there is no advantage about being on a H1b visa?

what exactly does it mean to sponsor a visa? I mean does the program have to pay money to the government or anything if they want a IMG or what is the problem?

There are J-1 waiver positions that are out there and you don't need to leave the USA to get them...

I C. So if you get a J1 waiver position you can stay as long as you want even after fellowship? (e.i. like a greencard)

Why do many programs donīt want to sponsor H1B visas? Does it cost them more money?

  #7

J1 visas cost about, what? $200?

An H1b will cost a program about $2600 each.

A J1 waiver is a permanent employment that will lead to a green card.

which is easier to find for fellowship?
also after resedency, is it harder to get H1b extension or J1 waiver?

  #9

J1 visa is much easier for fellowship. Many fellowships won't sponsor an H1b visa

J1 waiver has been easier the last 3-5 years.

I think m a bit confused abt these visa issues..wud b thankful if u can clarify..
I m an IMG do i need to pass step3 to get J1 visa?
I am a British Overseas citizen, wut r my chances of getting a visa..m not intending to stay in US after my residency, so no point in applying H1B.. And can i do residency with J1?

  #12

-You donīt need step 3 to get J1 visa. You only need it to get H1 visa.

-Yes you can do your residency with J1. If you donīt plan to stay in US after your residency, i donīt see any advantage of getting H1. Go for J1.

  #14

Hi Javed

applying 4 J1 visa is after confirmation of residency;no idea how long it takes...

CS visa is Business visa B1/B2;take an appointment with the embassy and complete the documentation required;how long it takes depends on when is ur interview date with embassy

I don't know what visa applicants travel on for the interviews - I can't answer that question. I assumed a B visa - either business or vacation.
