Hello dear all, I am flying up to USA in september and coming back homeland end of november. PLees kindly, advice if is this time enough to study for step3, start application procedure and also give the exam before returning back to country? and i might have to attend also some interviewcalls if i get in that time. plees i need good guidance if you know even littl bit. This forum is looking to be dead but I hoping somebody ans. my querries. God bless!takecare.

i heard nowdays is more difficult to get j1visa than h1/ is it correct?

NO!!!!!!!!!!!!!!! I still have two persons in their home countries waiting for the approval of the H1b visa - and they did have the premium processing paid. They don't even have the approval of the documents, so they can't schedule their interviews at the embassies. My persons on J1 visas arrived early, completed all their paperwork and are now working in the hospital taking care of patients.

hi there im a zombie here at the dead forum.. hope u dont get scared by me (my resting graveyard is pictured to ur left sept - nov : its enuf for s3 provided u get ur result of cs / last exam by sept.. bcoz it takes 1.5 months from day of release of cs result to day u get ur s3 permit.. my question - when do u plan to iview? dec - jan is peak period.. and i know a few ppl who had their j1 rejected.. prefer h1 if u can.. apurva

J1 is very easy to get rejected. Law is you have to show intent that you will come back to your home country. How to show intent? It is very subjective and depends upon the mood of visa officer. Getting J1 is same as getting B1/tourist visa but some what more easier than B1. H1 is a different animal. Even if you tell visa officer that you are not planing to coming back, he/she can't refuse visa as H1b kind of dual intent visa, meaning it has path to GC and citizenship.

My interviews (which I spent today coordinating 5 staff schedules trying to figure out when we can interview) will be November through late January. I'd say that 60-70% of my available interview dates fill within the first month of offering interviews. By the beginning of December, 95% of my interviews have been booked.

thanks so much for writting. i got confused h1 ji issue. but one point i got,,first in intervews is difficult to get h1 and easy to get j1 sponsering ,,then for many cases later is difficult to get in hand j1 and littlebit easy to get h1. apoorva how they reject j1 visa after they sign job? very badnews. BBB which place didnot giv h1approval documents for your person? arethey ecception or common case? anethor i read h1cap alredy filled for I.T. proffesinals in 2006 for 2007jobs, that is effecting us doctors also? i will hav to come back to country of stay after nov. to renew visa as my visa expires.so am upset what to do Apporva?but as BBBb said even i heard same thing and plan like this. i put first this post in step3 and there only one in step3 forum advise me cant finsh step3 in that short timeframe becaus documents processing is late/when latest u can give step3 for majority programes?

One case is the home government won't give an appointment and the other situation is that our INS/Homeland is dragging their heels......

hi bbb does it help if u have step 3 cleared before sep . i mean it can help in getting all the documenst for h1b cleared early. y are the people on h1b late at ur program. is it becuz of late step 3 results.

No - these persons had step three results back in February. It's all happening because of governments - a little of theirs and a little of ours.

j1 can get rejected for lack of intent to return to home country which is entirely visa officer dependant.. u have 2 options - return in nov and reapply for visitors visa from country with chances of rejection and losin out on iviews or extendin ur visa in oct.. it takes 3 months to just process ur applic.. so effectively u can return in feb even before they say yes or no.. h1 cap doesnt apply to docs bcoz most hospitals are not for profit.. and very few h1 visas are rejected at consulate.. its a headache for the program ppl but a much easier job for u.. hope that helps apurva

Apurva - H1 caps do count. It's not a matter of being "not for profit" - it's a matter of the extent of the teaching affiliations and the degree of affiliation.

i agree fully... but i usually just ask whether h1 or not.. the specifics are too dense for me to contemplate.. not contradictin u apurva

thanks for all for good information. i feel choosing h1 j1 is matter of individial prefrense but in end all is luck which one who gets. and also it will works out for the better. do u advice that i compulserily be present in USA dec and january for possible intervews?then i will have to renew my temperary visa of country where iam staying now before flying there.

i forgot to write another point. What if they give me 3months stay only at port of entry in airport? then it will become compulsery to return back in november. Should i tell official in the airport about intervews and to definitely give me 6 months stay?

try to be there for dec jan yes try to convince official for 6months duration stay u can still extend if they give u 3months apurva

but it is usually better if you dont extedn your very first visit, cause they say it affects the next time you are coming into the country
