hey all
i got a problem my h1b petition was approved and i have my i-797 and i have interviewed at my us embassy and they told me we'll call u and its been a week now so i started to panic and i'm posting this post
i currently have a valid b1/b2 .. everywhere i read about change in status it always mentions applying for h1b never have i read someone with approved petition and i797 in hand
my question is .. i start orintation in a couple of weeks .. if i dont wanna wait for the embassey to call .. can i enter us on my b1/b2 then apply to change in status by submitting that form with my i-94? is that the way to do it?
my main concern is how long does it take? i read somewhere as soon as i apply that makes in legal so i can start workin right away
by the way doesnt the i797 mean i am already in h1b status?
this is confusing .. i really need help .. i might be able to figuere it out on my own if i wasnt stressed
simple i have b1-b2 valid for another 4 years and i have a i797 which the embassy actually took from me! and i'm waiting embassy to call so i can stamp my visa .. do i need to do that? please help
