hi... I just obtained a position into a IL program and started the paper work. It is likely that I may get my h1b papers by 8 weeks from now. I am currently in US on a B1 and I94 expires early may. The problem is that no dates exist presently in the chennai consulate till september. Can I request for an emergency date so that I can begin my program on time? or should I try a I94 extension.... I am very confused and concerened and would really appreciate your help.

I-94 extension will not help you because you need to be in H1B status to start your residency and I-94 extension will keep you in B1 status. Contact the Chennai Consulate and find out whether they can schedule an earlier interview.

However after getting your H1B approved (Form I-797) you can technically work on the H1B approval without getting your Visa stamped, because at that point your status is H1B. BUT PLEASE NOTE this is a gray area of the law , so consult with an immigration attorney as to whether that option is viable. The safest approach would be to go back to India, get your H1B stamped and then enter the country with a H1B based I-94. I know all this might sound confusing, but US Immigration laws can be complex shaking head

u can contact chennai consulate,04442316767 is the chennai consulate number ...when did u get ur visa??i m gonna appear in chennai on june 23 rd for visa .........but now i have moved to delhi to show them 6 months stay to get the visa appointment as per the new visa policies in delhi consulate .........did u hear anything abt the recent rejection rates in chennai consulate????

yeah... I do know I could work on a approved H1 but it takes another 8 weeks and my B1 expires in 6weeks.... how can I stay for the remaining time.... thats why I was thinking of an extension.... n does someone..even chennai consulate refuse a H1b to docs.... that too something not in the 65k quota!!! Bah Im so confused with all this...

I emailed the chennai consulate n they said schedule at the earliest date... I called them n they said I can take an emergengy date but h1bs usually r refused.... and Ill need to make my point to the guy who ivs me..... man does this crap ever end!!!
