hey everyone

finally i finsished step 3 and i'm still in the us

i'm currently on a b1/b2 visa that expires on may 13th and so does my entry (i-94)

i'm thinking of applying for an extension of my b1/b2 status on basis of i will start working in late june and that my visa process (H1B) is already in progress

has anyone ever done this or knows if its gonna affect my future attempt to apply forgreen card?

my other question regardign this subject is:

if i was to go back to my country can i decide when my H1B starts?

if the program starts in late june can i get my visa to start in early june?

hi doorz, i have the same question. but i have seen in some visa forums that you have to go back to your country of origin to get a visa stamped. some people before have gone to canada and places in mexico like Juarez and Tijuana to get a H1B stamped. New rules regulate that you have to go back and come again. i was willing to stay back here and get my visa stamped if i could. i did even consult a lawyer online. i am yet to get a reply. if some one could shed light on this, i would be grateful. when you apply for a visa, there is an option that says " are you an indian citizen resident in the u.s" does it mean those who have been staying in the u.s for 4-5 months or those who have been staying here for a long time?

Do not change from b1/b2 to H1 as b1/b2=should return.Any change of status from b1/b2 not a good one to have in your history.



You have to get it stamped any way if you leave the country even for holiday.

Get it done now - it's worth it Highly unlikely to be rejected for h1

Extending B1/B2 is not advisable, in some immigration forums lawyers actually discourage it unless there are extenuating circumstances. It would be better if you go back to your home country and get H1B visa stamped once you get the I797 approved. H1B is a visa which is rarely rejected as YOU DO NOT HAVE TO ESTABLISH NON-IMMIGRANT INTENT. Have all your documents in order before you go for the Visa interview, you should be fine. Regarding Green Card, it is a whole different ball game.
