Hi guys, please help if you know the answers. I am now on H1 visa doing research, but I will have used 4 yrs of H1 if I start my expected residency, meaning only 2 yrs of H1 left. Website of some programs says you have to have 3 yrs of H1 to start the program. But when I ask a immigration lawyer, he said you can start working in hospital as long as you have program-sponsored H1 at the time, then you can submit green card application and extend H1. Please help.

Hi tdmed Did you ever get an answer to your question? I am in a similar position - I have done all steps EXCEPT step3 and was planning to apply for 6 year residency program... but I am not so sure now since I cannot get another 6 year H1b. It is so important to know this, since I will need to get step 3 before I apply if I can still get H1b for a residency spot. Any advice would be appreciated. BD

No - depending on the immigration official, you could get one year approval (which is all that is required, then you have to renew every year) or you could get three years (the max allowed at a time)
