My friend in Texas told me that there is new regulation on Chinese and Indians greencard application since 1st Oct 2005. According to this new regulation, after Oct. 1st, applicants are only allowed to submit Form 140. Once the 140 is approved, they need to wait for their notification to submit 485 application (the final step for greencard), which probably will take about 5 years since they haven't processed applications submitted in year 2000. Many chinese and Indians try to submit their their greencard application before Oct. 1st. I tried to searched the relative information from google with no result. Could anyone tell me if it is just a rumor or it is true? If it is true, does it mean all the Chinese and Indian H1b resident won't be able to get their green card before their H1b visa expired? Any reply will be very appreciated.

it's true, retrogression has begun from 1st oct...until they clear the backlog( for certain category extends to '99, for others 2002..), they wont process newer applications...right now, all employment based GC for Indian and Chinese are on hold...

and what if one gets married to a U.S citizen? does the non resident spouse have to stll undergo the same process????????

how badly does this affect us who will start H 1 in july 2006?

i dont think it will affect u...by the time u finish ur residency, retrogression should hopefully be over...drkpp, i think it applies only to employment based GC applications.

is it true that doctor s green cards applications are frequently rejected? i was told that this is often the case.......any inputs?

the rate of rejections for GCs depends on the application class. The majority of national interest waiver EB-2 and EB-1 applications are rejected(you can see the number at www.uscis.gov). The USCIS reserves the right to decline any application - you're particularly at high risk if you work outside the conditions of your visa (eg moonlighting on H1 or J1 visa) and will be rejected if you have a criminal charge (eg dangerous driving) brought against you.
