What is a waiver position. How one have to find it? If you want to get a J1 visa is it necessary to take step3? If once you have got J1 visa, is it possible to get a H1 visa then??????????

A waiver position is when you finish residency and you find a permanent employer who will sponsor you for a green card. You do not need step three to get a J1 visa. Once you have applied for a J1 visa, you cannot change to an H-1b visa.

hi guys , i have a query. if anyone gets rejected for a ji visa , does it mean you cannot apply again or cannot enter U.S ,even if you have a valid visitors visa. can you come in again and do your residency search , and can we come in to do an observership on a visitors visa ie- B1, B2. Please clear my doubts.

It's very unusual to get rejected for a J-visa. The grounds of the rejection will determine your subsequent eligibility for a b1/b2 visa, but you wouldn't be restricted from applying for a b1/b2 visa based solely on the fact that you previously applied for a J1. Remember that J-visa waivers are both expensive and hard to get, and you cannot apply for a waiver until you've completed years of work in a designated underserved area. You can apply immediately for a greencard from a H-visa as soon as your employer is willing. For more info, see www.internationaldoc.com

Yes, all waivers have to be certified by the department of agriculture or the Appalachian committe. Each state gets to waive the two year home residency requirement for just 30 people, but there are 50 states, so 1500 get this yearly. Nevertheless, there is often extensive legal competitions between physicians who don't want to have to go home, and the costs of obtaining a waiver job can be high, ~$15-20,000 or more. See www.immigrationportal.com for more info. CGR

Yes B1/B2 visitor visa is fine to take step 2cs. As long as you have completed your step 2cs by the end of Dec, it should be processed in time for the match. You apply for the visa as soon as you match - some applicants match outside of the NRMP; if so, you should apply as soon as you know where you're going to be training. The only requirement of the J1 home residency requirement is that you leave the US - there is no mandate to my knowledge that you actually have to work in your home country. Clearly before entering a country like Australia, you'd also have to apply for their training programs and visas etc. You're always better to be on a H1b if your employing hospital will take you on this visa class.
