Hi BBB:

I recently read about the new omnibus law taking into effect immediately, stating an increase in the number of H1B cap to 20,000 more. It also states the following:

"Further, the employer will be required to pay 100% of the prevailing wage. Previously, there was a 95% rule to allow for some flexibility in cases where an employer was allowed to pay 95% of the government-determined prevailing wage"

does this mean that the hospital is required by law to shoulder the preocessing fee of H1B's?

Yes, except for the premuim processing which is HIGHLY recommended.

Hi BBB,
I`m really impressed by all the advise you have posted.
Please see if you can help me with this one...
I have travelled to the US once. So can i take steps 1 & 2 in india, and apply for a visitor visa again on the same grounds as before( my sister lives in the states) and take step 2 CS.
Is there there any other way the consul comes to know that i`m going for CSA unless i tell him ?

I really can't answer that question - I haven't much experience with consulate employee's (well, except for that period of time in the 80's...). Another applicant would be able to help you better than me.

in actuality, do hospitals shoulder the H1B processing and just ask for the 1000 premium processing from applicants? thanks for all your help , BBB. Happy holidays!

They are supposed to pay from the processing - we do. It's written into the rules that the employer is supposed to pay. If the hospitals are making applicants pay it back, then they are breaking the law.

The $1000 processing goes directly to the attorney for immigration - not to the hospital......
